When Judge Rajah ordered Scott Dylan’s co-conspirator, Jack Mason, to hand over his passport it was to prevent him absconding and scuttling, like a cockroach, back to Spain.

Dylan, on the other hand, kept his passport. The judge believed him to be living in the UK. It now appears from his weird blog that he lives in Dublin. The question is whether Dylan will return to be sentenced….

Next year he has to defend himself from the charge that he conspired to unlawfully to nick £13.8 million from Barclays. Hundreds of people have suffered at the hands of Dylan aka Reece Dylan and Reece Widdington. Many were from this parish. We need to see Dylan back in the High Court to face justice

    So, if Dylan thought he was free of UK law he was wrong

    Section 2(1) of the Ireland Act 1949 states as follows:
    It is hereby declared that, notwithstanding that the Republic of Ireland is not part of His Majesty’s dominions, the Republic of Ireland is not a foreign country for the purposes of any law in force in any part of the United Kingdom or in any colony, protectorate or United Kingdom trust territory, whether by virtue of a rule of law or of an Act of Parliament or any other enactment or instrument whatsoever, whether passed or made before or after the passing of this Act, and references in any Act of Parliament, other enactment or instrument whatsoever, whether passed or made before or after the passing of this Act, to foreigners, aliens, foreign countries, and foreign or foreign-built ships or aircraft shall be construed accordingly.

    Well actually I believe Mason was granted on appeal his passport back and is now back in Spain.

    Under the law of civil contempt there is no extradition. So Mason can stay in Spain and be untouchable.

    It will be interesting to see how the appeal to the judgment plays out which has to be lodged in October.

      I do not believe that Mason was granted the return of his passport on appeal.

      In order to Appeal against an order of a High Court Judge, Mason would have needed Leave from the High Court to do so. It is highly likely that any Justice of the High Court sitting in the Administrative Court would refuse to grant Mason’s Application for Leave to Appeal.

      In any event, the long legal summer holiday has intervened since Mr Justice Rajah made the order which he did and any representations that Mason might have tried to make to the Court of Appeal directly, without leave, would have taken a back seat and still not have seen the light of day.

      Before the Barrack Room lawyers involved in this swindling of £13.7 million try to argue that there is a right to travel overseas, or some sort of a spurious human right to do so, let us put the matter straight now.

      British Passports are issued by virtue of the Royal Prerogative. There is no Act of Parliament that confers a British Passport on any of His Majesty’s Subjects. No British Citizen has a “right to a passport.”

      If the Passport Office or British Embassy refuses to issue a passport, it is not possible to apply for a Judicial Review of the Home Secretary’s decision because in English law, the exercise of Prerogative Powers is not justiciable. The term “not justiciable” means not actionable in Court. Criminals who fled to the Costa Del Crime in the 1980’s applied to the British Embassy in Spain to renew their passports. Their applications for passports were denied. They instructed lawyers to bring an action in the High Court in London. The High Court dismissed the application on the basis that passports are issued under the Royal Prerogative and the exercise of those powers is not justiciable.

      So, Dylan could be the subject of extradition if Judge Rajah is so minded

    He does not appear to have sold his house on Wadlow Close in Salford to which he has the title. I think he would sell this first and then move. Keeping an eye on Zoopla and RightMove for properties for sale.

    I am sure that this shyster’s luck will run out one day……..In the meantime, he has his share of £13.7 million courtesy of Barclays Bank. No wonder shareholder value in the Bank is so poor these days with embezzling shysters like this conning them.

    I think he should have been reported to the Police by the Bank.

    I had hoped that he would be shafted at the sentencing hearing.
